Can I Patent a Business Idea?

You cannot specifically patent a business idea; you can only patent the physical embodiment of an idea or for a process that produces something tangible or that can be sold. Thus if you can create diagrams and plans for your item, those diagrams may be patented. An idea that relates to something non-tangible such as a better way to win at poker would not be eligible for registration as a patent.
