What Do Signs ™ and ® Mean?

The ™ and ® marks have no legal significance or meaning in Canada. Thus there are no repercussions to using these marks. Surprisingly neither the ™ nor the ® mark appears in official Canadian Trademark Law.

Unofficial meaning of the ™ mark has come to mean unregistered trademarks or in-process trademarks while the ® has come to mean registered trademark. If you sell into the United States, usage of either symbol without a US trademark registration may prohibit future registration of your trademark in that country.

When to Use ™ Symbol in Canada?

This symbol has no legal significance. You can use it to indicate that something is a trademark, but the Canadian Trade-marks Act does not regulate use of this symbol.

Canada's Trade-marks Act does not include any marking requirements. However, the following symbols are commonly used by trade-mark owners to indicate registration:

  • ® (registered)
  • TM (trade-mark)
  • SM (service mark)
  • MC (marque de commerce)
